Terms of Service

Welcome to FairlyQuoted. These Terms of Service ("Terms") govern your use of the websites and applications at fairlyquoted.com and app.fairlyquoted.com (together, the "Platform"), operated by FairlyQuoted ("we," "us"). By creating an account or using the Platform you agree to these Terms. If you don't agree, please don't use the Platform.
1. What FairlyQuoted is (and isn't)
FairlyQuoted is a marketplace that connects homeowners ("Consumers") with independent home-services contractors ("Contractors"). We provide pricing estimates, job listings, messaging, and related tools. We are not a contractor, and we are not a party to any agreement between a Consumer and a Contractor. Contractors on the Platform are independent businesses — not our employees, agents, or subcontractors. We do not supervise, direct, or control their work.
2. Estimates are guidance, not quotes
Our instant estimates are generated from market data and automated analysis of the information you provide. They are preliminary guidance only — not a quote, bid, guarantee, or offer to perform work at any price. Actual prices are set solely by Contractors through their bids, and may differ from our estimates. Site conditions, scope changes, and hidden damage routinely change final prices.
3. Accounts and eligibility
You must be 18 or older and able to form a binding contract. You're responsible for the accuracy of the information you provide and for anything that happens under your account. One person or business per account. We may suspend or terminate accounts that violate these Terms, harm other users, or abuse the Platform (including fake jobs, fake bids, or fake reviews).
4. Phone verification and communications consent
Posting a job requires verifying a mobile number; we send a one-time code by SMS. By providing your number you consent to receive that verification message and transactional messages about your jobs and account. Message and data rates may apply. We send transactional email about your account activity (bids, messages, contracts); marketing email is separate and always includes an unsubscribe.
5. Bidding and hiring
Bidding is blind: Contractors do not see our estimate or other Contractors' bids. Bids are the Contractor's own numbers and may be ranges pending a site visit. When a Consumer accepts a bid, contact details are shared between the two parties and any resulting agreement is directly between the Consumer and the Contractor. Payment for work is made directly to the Contractor unless we explicitly state otherwise.
6. Contracts, e-signatures and invoices
The Platform offers optional tools for generating scope-of-work documents, signing them electronically, and requesting payments. By using e-signing you consent to transact electronically under the U.S. ESIGN Act; you may request paper copies. These documents are templates — we are not a law firm and provide no legal advice. Have any contract reviewed by a licensed attorney if you want legal certainty.
7. Contractor terms
Contractors represent that they hold all licenses, registrations, and insurance required for the work they bid on, and that information they provide (including insurance attestations) is accurate. Bidding on marketplace jobs is free. Optional paid subscriptions ("Pro") are billed as described at purchase; founding-rate pricing remains only while a subscription stays active. Contractors are solely responsible for their bids, work, permits, taxes, and compliance with laws (including contractor licensing and consumer-protection laws in their jurisdiction).
8. Reviews and content
Reviews may only be left for completed Platform jobs. You agree not to post content that is false, defamatory, harassing, infringing, or unlawful. You grant us a non-exclusive license to display content you post on the Platform. We may remove content or flag reviews that our integrity systems or moderators determine to be manipulated or in violation of these Terms; Contractors may respond publicly to reviews. We don't sell your contact information — messaging is filtered to protect it until a bid is accepted.
9. Fees
The Platform is free for Consumers. Contractor Pro subscriptions are billed via Stripe; you can cancel any time from the billing portal, effective at the end of the current billing period. Subscription fees are non-refundable except where required by law.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THE ACCURACY OF ESTIMATES, THE QUALITY OF ANY CONTRACTOR'S WORK, OR THAT ANY JOB WILL RECEIVE BIDS. YOUR RELATIONSHIP WITH ANY CONTRACTOR OR CONSUMER IS AT YOUR OWN RISK; VET THE PEOPLE YOU HIRE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAIRLYQUOTED WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DISPUTE, LOSS, OR DAMAGE ARISING FROM WORK PERFORMED (OR NOT PERFORMED) BY A CONTRACTOR. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
12. Disputes between users
If something goes wrong between a Consumer and a Contractor, we encourage both parties to use the Platform's messaging and reporting tools; we may, at our discretion, review records to help mediate, but we have no obligation to resolve user disputes and no liability for their outcome.
13. Changes and termination
We may update these Terms; material changes will be posted here with a new effective date, and continued use after that date is acceptance. You may stop using the Platform at any time; account deletion requests can be sent to hello@fairlyquoted.com.
14. Governing law and contact
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules. Questions: hello@fairlyquoted.com.
